Airlines for America formally ends EU ETS lawsuit


Airlines for America (A4A) said Tuesday it will no longer pursue its lawsuit against aviation's inclusion in the European Union's Emissions Trading Scheme (EU ETS), and instead will back efforts by Congress and the Obama administration to challenge the EU on the issue.
A4A's lawsuit brought the legal question of non-EU airlines' inclusion in the ETS, which started Jan. 1, to the Court of Justice of the EU (CJEU). The court last year ruled against A4A, stating that international aviation's inclusion in the ETS violates neither international law nor the EU-US open skies accord.
A4A president and CEO Nicholas Calio said the lobbying group's lawsuit had helped shed light on the ETS's shortcomings and noted that its arguments "are now key points in the [US and other world] governments' unified opposition to the scheme."
He emphasized that while A4A sees no more to be gained from pursuing formal legal action against the ETS, the group and the carriers it represents "remain steadfastly opposed to the application of this cap-and-trade tax scheme to US airlines and aircraft operators and are committed to seeing it overturned".
